This action was brought by writ of certiorari in the District Court of Bernalillo County to review the decision of the Employment Security Commission of New Mexico (Commission) disqualifying the petitioner-claimant (LeMon) from the receipt of unemployment compensation benefits for having left his employment "voluntarily without good cause in connection with his employment" as provided in § 59-9-5(a), N.M.S.A. 1953 (Supp.1975). The district court, sitting without a jury, reversed the Commissions decision on the grounds that LeMons termination of his employment (on the advice of his physician because of an increase of blood pressure) was not "voluntary" within the meaning of the statute, but compelled by health reasons. The Commission has appealed.
